Course Description: Cette Focus Week, offerte en français, permettra aux étudiant(e)s d’examiner ces questions en profondeur, ainsi que plusieurs autres enjeux connexes. Elle est divisée en trois grands blocs d’apprentissage : un bloc contextuel, un bloc théorique et un bloc pratique. Le premier vise à approfondir les connaissances des étudiant(e)s quant aux origines, à la nature et à la portée des clauses dérogatoires, ainsi qu’à l’historique de leur utilisation. Le deuxième a pour objectif de familiariser les étudiant(e)s avec les principaux débats théoriques qu’elles suscitent. Le troisième porte sur les litiges en cours devant les tribunaux en lien avec l’interprétation de l’article 33 de la Charte canadienne. Ultimement, cette Focus Week devrait permettre aux étudiant(e)s de développer une perspective nuancée, critique et pratique sur les clauses dérogatoires, ce qui leur permettra également de mieux comprendre les implications des jugements de la Cour suprême à venir dans les dossiers Commission scolaire English-Montréal, et al. c. Procureur général du Québec et al. et Saskatchewan v. UR Pride Centre for Sexuality and Gender Diversity.
TQR: At a minimum, a first degree in law. Several years of significant practice or professional experience, in the relevant area; Experience in teaching undergraduate law students in a bilingual setting.
