The Position
Nimble Legal manages a substantial legal recovery portfolio covering pre-litigation engagement, post-summons litigation, enforcement and settlement. The portfolio includes SME and commercial accounts, as well as high-balance accounts originated by banks, and consists primarily of acquired debt matters involving juristic persons and individual sureties.
Nimble Legal is recruiting five Legal Recovery Consultants. These positions are aimed at LLB graduates who have completed their articles of clerkship, whether newly admitted as attorneys or awaiting admission, and who are ready to move directly into a commercially driven legal recoveries environment. This is an in-house legal recovery position within a creditor business and is not a traditional private-practice attorney role.
The Legal Recovery Consultant engages directly with principal debtors and sureties across both pre-litigation and post-summons matters, with the objective of securing payment, settlement, or a structured payment arrangement – whether in place of formal legal action or prior to further enforcement where proceedings are already underway.
This is a hands-on role requiring decisive action, structured engagement, sound judgement and the ability to move matters towards resolution within defined timeframes. The consultant works within approved negotiation parameters and promptly escalates matters that cannot be resolved through engagement.
Structured negotiation training and mentorship are provided from day one, building on relevant litigation and debtor-engagement exposure gained during articles.

Key Performance Areas:
Debtor and Surety Engagement
• Engage debtors and sureties at the pre-litigation and post-summons stages through focused, outcome-driven telephone and written communication.
• Apply a structured approach to debtor interactions and guide conversations towards a defined outcome.
• Accurately and professionally communicate the legal consequences of non-payment, as well as the status of proceedings.
• Apply a time-bound engagement strategy, avoiding repeated unproductive contact and promptly escalating non-responsive matters.
Negotiation and Resolution
• Negotiate settlements and structured payment arrangements within parameters approved by management and the senior attorney, including settlement discounts and instalment arrangements.
• Secure sustainable agreements by confirming debtor capacity and commitment before finalising any arrangement.
• Prepare and issue settlement agreements and payment confirmations.
• Manage payment commitments and follow up on arrangements to ensure compliance.
Escalation and Reporting
• Escalate non-responsive or non-compliant matters for further legal action, providing full context and a clear recommendation.
• Maintain accurate and up-to-date records of all debtor engagement, outcomes, and next steps in the relevant internal system.
• Provide structured updates on engagement progress, conversion outcomes, and identified risks or bottlenecks.

Minimum Requirements
• Essential:
o LLB degree and completed articles of clerkship; candidates awaiting admission are welcome to apply.
o Demonstrable litigation and/or debt collection exposure gained during articles, for example summonses, default judgment applications, warrants of execution, pre-litigation demands and negotiations, or debt recovery and contractual disputes.
o Working knowledge of the South African civil litigation process, including section 129 notices, summons, service, default judgment and enforcement.
o Sound understanding of professional and ethical communication with debtors once legal proceedings have commenced.
o Demonstrated assertiveness and negotiation aptitude, evidenced during articles, with the ability to manage difficult conversations and work towards resolution.
o Strong organisational capability, including follow-up discipline, accurate record-keeping and structured reporting.
o Ability to take ownership of outcomes and work within defined targets, performance metrics and approval parameters.
o Proficiency in MS Office and digital communication tools.
• Advantageous:
o Admission and enrolment as an attorney
o Exposure to acquired or ceded debt, banking litigation, or SME and commercial recovery matters
o Exposure to matters involving juristic persons and personal sureties
o Familiarity with NCA compliance requirements in a collections or consumer credit environment
o Moot court, mock trial, mediation or other client-facing negotiation experience
o Experience using AI-assisted drafting tools responsibly, including independently verifying all outputs.
