Description

The position reports to the Human Resources Director. Work is directed and reviewed through the establishment of goals and subsequent evaluation of progress toward goal attainment.

Workdays and Hours - Monday - Friday 8:00am - 5:00pm

Anticipated starting salary:  $66,342 - $94,184 (based on experience and qualifications)

  • Helps to create, implement, and maintain the Equal Employment Opportunity (EEO) program.
  • Gathers, compiles, analyzes, and interprets data necessary for external (government) and internal EEO compliance, reporting, and monitoring. Data may include recruitment, hiring, terminations, promotions, disciplinary actions, salaries, applicant flows, and transfers.
  • Plans, completes, and files required EEO and/or affirmative action reports and documentation with government agencies.
  • Uses appropriate statistical software or tools to measure and monitor equal opportunity and affirmative action plan compliance.
  • Reports survey results, statistics, and recommendations for corrective action to the Equal Employment Opportunity Manager and other appropriate stakeholders.
  • Addresses internal inquiries regarding civil rights and equal opportunity laws and regulations as appropriate based on the specialists expertise; refers sensitive issues and concerns to manager or appropriate legal staff.
  • Pursuant to established documentation procedures, records discriminatory factors and corrective actions identified through investigations of employment practices or alleged violations.
  • Ensures timely processing and review of complaints by coordinating, monitoring, and streamlining complaint procedures.
  • Responds within 24 hours to claims filed via telephone, walk-in, or the online system involving equal employment opportunity, sexual harassment and/or violence in the workplace issues. Arranges to meet with complainant(s) to take full statement, makes initial determination if case falls within jurisdiction and completes appropriate in-take forms.
  • Updates and maintains a case management and tracking system with appropriate information.
  • Conducts investigations of routine to moderate complexity through follow-up interviews with complainant(s); arranging and completing interviews with witnesses, supervisors, and managers as appropriate. Keeps manager apprised of case progression.
  • Research relevant policies, rules and laws (federal, state, local) that apply to cases under investigation.
  • Prepares preliminary reports outlining findings and submits a recommendation of sustained or un-sustained and course of action to the manager for review and approval. Prepares and maintains a folder of all case related documents in a format that facilitates legal review.
  • Issues letters informing parties of recommended actions and follows-up to ensure recommendations are carried out.
  • Stays abreast of federal, state and local laws, as well as court cases and trends regarding discrimination, harassment, case management, and best practices.
  • Facilitates all parts of the ADA process including medical certification collection, interactive dialog, accommodation determination, and accommodation implementation.
  • Assists in the development of policies and procedures and conducts training programs and workshops, as required.
  • Provides data analysis reports related to EEO such as adverse impact analysis, trend analysis for cases, and other data analysis as required.
  • May be asked to serve on committees or other boards related to this area of specialty.
  • Develops and administers the City's Affirmative Action and EEO compliance programs.
  • Investigates and facilitates resolution of employee problems that may involve discriminatory activities.
  • May supervise other professional or support staff.
  • Completion of work assignments may require the operation of a vehicle.

  • Considerable knowledge of principles of human resources management
  • Knowledge of federal, state and local regulations affecting human resources practices
  • Ability to use a computer to access, interpret, and record information
  • Ability to develop and maintain effective working relationships with associates, employees of other Departments, representatives of outside agencies, and the public
  • Ability to communicate clearly and effectively, orally, in writing, and/or by whatever creative means are necessary to cross communication barriers
  • May require ability to plan, organize and supervise the work of others
  • May require ability to acquire and maintain a valid Kansas driver's license
  • An employee shall not pose a direct threat to the health or safety of other individuals in the workplace.

Required Experience and Training:

  • Bachelor’s degree from an accredited four-year college or university in Human Resources, Business Administration, Legal Studies, Public Administration, or Industrial Relations.
  • Five (5) years HR experience, with primary responsibility for employee relations, employment compliance, EEO, or ADA administration.
  • Three (3) years of experience conducting workplace investigations, including interviewing complainants, respondents, and witnesses; reviewing personnel records and other evidence; documenting investigative findings; preparing written investigative reports; recommending corrective actions; and presenting findings and recommendations to management or legal counsel.
  • One (1) year of experience managing the ADA interactive process, including evaluating medical documentation, determining reasonable accommodations, and assessing undue hardship.
  • A valid driver’s license.
  • Must be legally authorized to work in the United States without the need of a sponsorship.  

Preferred Experience and Training
  • Master’s degree from an accredited college or university in Human Resources, Business Administration, Public Administration, Industrial Relations, Employment Law, or a Juris Doctor (JD).
  • Professional HR or compliance credentials such as SHRM-SCP, SPHR, or Certified Civil Rights Investigator (CCRI).
  • Two (2) years of experience responding to administrative charges or complaints filed with the Equal Employment Opportunity Commission (EEOC), Kansas Human Rights Commission (KHRC), or another governmental civil rights enforcement agency, including preparing position statements, gathering supporting documentation, communicating with agency representatives, or participating in mediation.
  • Two (2) years of experience tracking EEO or employment compliance metrics, analyzing workplace complaint trends, and preparing EEO-4 or Affirmative Action Plan (AAP) reports.
  • Two (2) years of experience developing and delivering training to employees, supervisors, or managers on EEO, anti-discrimination, anti-harassment, workplace investigations, ADA requirements, or reasonable accommodation responsibilities.
