ESSENTIAL FUNCTIONS: Essential functions may include but are not limited to the functions listed below. Must be able to perform the essential functions of the job with or without a reasonable accommodation.
- Plan, oversee, coordinate and negotiate the purchase of real property for the City of Albuquerque requested by City Council and City departments, to include rental, lease or disposal of real property, rights-of-way, easements, or other property rights; request and review City Council budget appropriation for acquisitions.
- Evaluate and determine which properties should be presented to City Council for surplus determination; ensure compliance of City ordinances, State and Federal laws and regulations for surplus sales.
- Initiate, prepare, review and negotiate offers for acquisitions to include letter of offers and contingencies; consult with the Legal Department as needed; prepare contracts, agreements, and other documents for real property transactions.
- Research and respond to property issues and questions from the general public, City Council, City Departments, outside agencies and Real Property Staff; provide requested documents; and evaluate, communicate and resolve issues as needed.
- Coordinate the acquisition process with property owners, tenants, legal representatives, upper level administration and outside agencies; consult with engineers, attorneys, surveyors, and developers regarding status of projects.
- Represent the City in exercising its Right of Eminent Domain; prepare data for condemnation actions; inform and counsel property owners, representatives and attorneys regarding condemnation laws, relocation benefits, the acquisition process and questions regarding the appraised value; prepare applicable documents, reports and correspondence; coordinate with the Legal Department in condemnation of properties and settlement negotiations.
- Order and evaluate title reports, deeds, and plans to determine legal rights of ownership and institute procedures to clear titles; coordinate with property owners and title companies to resolve any title issues prior to closing to ensure the City is receiving marketable title to property.
- Inspect and evaluate various properties for potential acquisition for City projects; request, coordinate and review appraisals, surveys and environmental reports to establish feasibility of purchase and fair market value; resolve survey, encroachment or easement issues; consult with the Legal Department and applicable parties regarding issues.
- Supervise and participate in the closing of City purchased properties in coordination with the Legal Department; review, evaluate and sign off on closing documents; inform title company of closing process; ensure funds are delivered to the title company and closing documents are filed with the City Clerk.
- Participate in the development of policies and procedures for the Real Property Division
- Input, update, and track Real Property agreements in database; manage and monitor terms and conditions; verify billing and payments are current and accurate; investigate, resolve and reconcile contract payment issues for contractor, title companies and other departments.
- Select, train, motivate and evaluate personnel; provide or coordinate staff training; work with employees to correct deficiencies.
- Participate on a variety of boards and committees; prepare and present reports regarding Real Property acquisitions; may present and justify recommendations to management, upper level administration and various committees.
- Participate in preparation and administration of assigned budget; submit budget recommendations; monitor expenditures.
SUPPLEMENTAL FUNCTIONS:
- Represent the Real Property Division at staff and City Council meetings as requested by the Real Property Division Manager.
- Research and respond to 311 calls regarding City property questions and issues; coordinate repairs and maintenance; resolve issues; route calls as needed.
- Perform related duties and responsibilities as required.
Education and experience directly related to the minimum requirements below may be interchangeable on a year for year basis.
Bachelor's degree in marketing, business administration, or real estate; and
Five (5) years of commercial real estate broker experience; and
To include two (2) years of supervisory experience.
Government Real Property acquisition experience preferred.
ADDITIONAL REQUIREMENTS:
Possession of a valid New Mexico Driver's License, or the ability to obtain by date of hire.
Possession of a City Operator's Permit (COP) within six (6) months from date of hire.
Possession of a New Mexico Real Estate License, Associate Broker or Qualified Broker.
Environmental:
Office and field environment; may travel from site to site; exposure to computer screens, inclement weather conditions.
Physical:
Essential and supplemental functions may require maintaining physical condition necessary for walking, standing or sitting for prolonged periods; light lifting and carrying.
