Job Summary
The Associate General Counsel, Employment serves as a strategic legal advisor and key member of the Legal Department, providing comprehensive legal guidance and business counsel on a wide variety of labor and employment matters.   This role partners closely with cross-functional teams to manage legal risk, support organizational objectives, and ensure compliance with applicable federal, state, and local laws and regulations.


The incumbent navigates the complex intersection of federal/state employment statutes and the unique regulatory frameworks governing Medicaid-funded home and community-based services (HCBS).  This position will directly advise executive leadership and HR teams on workforce management, compliance, and risk mitigation for both corporate staff and, in some programs, a caregiver.


This is a fast-paced role that requires exceptional organizational agility. 


Key Responsibilities


Employment Compliance & Advice

  • Provide day-to-day legal advice on wage and hour laws, FMLA, ADA, Title VII, and state-specific employment statutes.
  • Address unique home care workforce challenges, including live-in caregiver exemptions, travel time compensation, and joint-employment risk.
  • Monitor changing federal and state labor laws impacting the Medicaid and healthcare sectors.

Medicaid & Regulatory Integration

  • Align employment practices with Medicaid provider enrollment rules, Electronic Visit Verification (EVV) mandates, and state program integrity requirements.
  • Advise on background check compliance, exclusion screenings (OIG/LEIE), and mandatory health screenings for field staff.
  • Collaborate on audit readiness for state health departments and managed care organizations (MCOs).

Policy & Contract Management

  • Draft, update, and implement employee handbooks, arbitration agreements, and separation agreements.
  • Review and structure independent contractor agreements and vendor contracts to minimize misclassification liability.
  • Design and deliver training programs for HR and operational managers on employment best practices.

Litigation & Dispute Resolution

  • Manage and resolve pre-litigation employment demands, administrative charges (EEOC/state agencies), and wage audits.
  • Oversee outside counsel during active employment litigation or class-action defense.
  • Lead internal investigations regarding allegations of harassment, discrimination, or retaliation.

Required Skills:

  • Ability to apply state and federal anti-discrimination and wage-hour requirements to complex business operations.  
  • Ability to draft clear and well-organized position statements and other legal documents.
  • Ability to negotiate and draft settlement agreements and releases.
  • Ability to manage state and federal employment-related litigation. 
  • Ability to communicate clearly and concisely with executive leadership and to translate legal concepts into practical business solutions.
  • Ability to provide sound and well-reasoned legal and practical judgment and guidance.
  • Ability to manage a high volume of urgent requests. 
  • Ability to apply state and federal information privacy and security requirements to the employment arena. 
  • Ability to draft clear and concise documents including policies, contracts and memoranda.  
  • Excellent legal, writing, and interpersonal skills.

Qualifications:


Education:

  • Juris Doctor Degree and current license to practice law.
  • New York or California bar admittance a plus.

Experience:

  • Minimum of 10 years of focused labor and employment law experience required.
  • Prior in-house and/or large law firm experience is preferred.
  • Strong labor relations expertise, including collective bargaining negotiations, NLRA compliance, labor arbitrations, union organizing matters, and employment risk mitigation, is highly desirable.
  • Experience supporting Medicaid Home and Community-Based Services (HCBS) programs is a plus.

Working Conditions:   

Remote with occasional business travel


Supervisory Responsibility (If applicable):   

May manage one or more paralegals.


Compensation Range: $180,000 - $215,000 / annually


This role is eligible for a base salary within the posted range. Actual compensation will be determined based on a variety of factors, including skills, experience, and geographic location. Compensation may vary for positions based in high cost-of-labor markets.
