Deputy District Attorney V (Part-time only)

The District Attorney's Office is responsible for the prosecution of all crimes or offenses that occur within the County. District Attorney staff represent the People of the State of California in criminal cases, provides support and assistance to crime victims, and work in partnership with local law enforcement agencies to promote public safety. Our mission is JUSTICE WITH INTEGRITY.

Our staff consists of approximately 144 full-time employees. This recruitment is being conducted to fill part-time/extra-help Deputy District Attorney V vacancies for the Stanislaus County District Attorney’s Office. Eligible lists are normally good for six months and may be extended for up to one year.

ATTORNEY V

• Handle any and all types of legal prosecution matters as a part-time extra-help Attorney V for the District Attorney’s Office.
• May include responsibility for a specialized unit; and
• Other duties as assigned

Demonstrate ability with level IV requirements PLUS:
Criminal:

• Competently defend/prosecute all cases including homicides; and
• Willingness to defend/prosecute capital cases; and
• Assume the full range of responsibilities relating to the office.

• Prepare and present statements of fact, law and arguments clearly and logically in written and oral form;
• Evaluate facts and evidence and obtain information through examination;
• Initiate and prosecute criminal actions;
• Analyze difficult and complex legal problems and apply legal principles and practices;
• Win the confidence and respect of members of the legal profession, public officials, and other persons contacted in the work environment.

• Prepare the most difficult and complex cases and motions in IV-D related cases and be able to argue these cases in State and Federal Courts;
• As a technical expert in a specialized area of Family/Criminal law, advises other deputies and Child Support Enforcement support staff on precedent, decision and developments in the law;
• Must have the ability to discuss public policy issues and the ramifications of appealing cases with the Attorney General's Office in light of current law;
• Analyze proposed legislation and its impact on the Child Support Enforcement program;
• Recommend changes to format and forms of the Judicial Council; and
• Ability to identify policy issues and recommend statutory changes in favor of the program and its goals.

• Apply knowledge previously learned in Level I, II III and IV; and
• Advanced legal research and writing

• Advanced knowledge of specialized statutes including sentencing and enhancements.
• The duties, powers, limitation and authority of the District Attorney's Office and Public Defender's office as applicable;
• Legal principles and their application;
• Trial procedures and rules of evidence; and
• Legal research methods.

• One (1) year experience as an Attorney IV or equivalent; AND
• Pass California State Bar and possess valid bar license; AND
• Other-- Complete and pass background investigation at time of initial hire.

THE FOLLOWING APPLY FOR ALL LEVELS OF DEPUTY DISTRICT ATTORNEY LICENSE

• Active membership in good standing in the State Bar of California is required at the time of appointment. The Bar Membership Number should be listed in the Licenses section on the application form.

• 5 years' experience working as a Deputy District Attorney in a District Attorney's Office

• Application Review and Screening. Applications are carefully screened based on information provided. Those who submit incomplete applications that lack relevant qualifications or do not submit all required documents will not be invited to move on. 
• Written Examination. Applicants will be invited to participate in a written exam that tests knowledge for the position. 
• Oral Examination. Applicants are invited to a panel interview in which they will be evaluated by County subject matter experts. 
• Eligible Lists. Candidates who pass the examination will be placed on an eligible list for that classification.  Eligible lists are effective for six months but may be extended up to eighteen months.

CLASSIFICATION INFORMATION

Part-time extra-help is a provisional classification where permanent status may not be obtained. This position is subject to overtime, standby, shift, and callback assignments and will perform related duties as assigned. This position is non-benefited except for participation in a 401a program with Nationwide.

• Pass County-paid pre-employment job-related background investigation.

• Some positions may be required to possess and maintain a valid California Driver’s License and meet County insurability requirements.

APPLICATION AND/OR EXAMINATION APPEAL RIGHTS

Application and/or examination results may be appealed by applicants presenting facts alleging irregularity, fraud and/or error in application screening or in exam scoring. Appeals must be in writing and submitted to the Chief Executive Officer within seven (7) days after the examination results are emailed.
