Description of Work
The primary purpose of the Clerk’s Office in the Office of Administrative Hearings (OAH) is to assure that the filing, processing, docketing, indexing, recording, closing, and preserving of documents and records of all contested cases that before OAH are complete, and in compliance with the statutory requirements of North Carolina General Statues (G.S. Chapter 150B). The Clerk’s office is responsible for the integrity of all Contested Case Hearings filed with the office.The primary purpose of this position is to ensure that the processing, docketing and resolution of all contested cases filed are efficiently and effectively performed within the statutory requirements of N.C.G.S 150B. This position, along with the support of the Chief Hearings Clerk, determines the workflow within the Clerk’s Office. This position is one of the main contacts for individuals calling or appearing at OAH to start the appeals process. This position analyzes and processes petitions filed to ensure completeness, proper case type, filing fee and statutory deadlines.
Knowledge Skills and Abilities/Management Preferences
This position processes filing fees, creates receivables, and coordinates receipts with the fiscal division for completeness and accuracy to determine overpayment/underpayment of filing fees, issue refund requests, and processes Bonds, in addition provides status reports for any inquiry. The Deputy Clerk prepares and forwards the Official Records for Proposed Decisions to go to the proper agency for Final Agency Decision. Position is responsible for preparing the Official Records for Petitions for Judicial Review within statutory requirements, plus forwards and tracks the Petitions for Judicial Review. This position is responsible for staying up to date with any changes to N.C.G.S. 150-B and NCAC Title 26 and OAH policies and procedures and may assist with training other employees. This position may be called upon to act as a Hearing Assistant to record Contested Case Hearings and acts on behalf of the Chief Hearings Clerk in their absence and administers the Chief Hearings Clerk’s activities.
Knowledge, Skills, and Abilities / Competencies:
• Proficiency with MS Word, Excel and MS based database administration.
• Considerable knowledge of office management and court case management procedures and techniques.
• Knowledge of accepted court procedures.
• Knowledge of compiling, assimilating, and organizing both printed and electronic information. Experience in applying knowledge of date collection, storage, organization, manipulation and/or analysis of data.
• Experience in identifying and understanding issues, problems, and opportunities; use effective approaches for choosing a course of action or developing appropriate solutions.
• Experience in analyzing, interpreting, recommending, and implementing policy and procedural guidelines.
Management Preferences:
Legal or Administrative Court experience.

High school diploma or General Educational Development (GED) diploma and four years of related administrative experience; or equivalent combination of education and experience.
