Legal Associate
Responsibilities:
- Drafting and vetting commercial contracts, including:
- Loan Agreements
- Sale of Business Agreements
- Cessions
- Joint Venture Agreements
- Shareholders’ Agreements
- Partnership Agreements
- Service Level Agreements
- Residential and Commercial Lease Agreements
- Acknowledgements of Debt
- Deeds of Suretyship
- Wills
- Managing High Court and Magistrate’s Court litigation across civil and commercial matters.
- Taking instructions from clients and managing matters from inception through to resolution, including:
- Drafting pleadings, notices and legal documentation.
- Negotiating settlements and drafting settlement agreements.
- Preparing briefs for Counsel and consulting with Counsel.
- Appearing in Court and conducting trials.
- Drawing and presenting Bills of Costs.
- Managing all aspects of debt recovery, including Section 65 enquiries in terms of the Magistrates’ Courts Act.
- Handling sequestration matters across all stages.
- Managing liquidation and judicial management matters.
- Managing matrimonial and maintenance litigation.
- Preparing legal opinions relating to the King III Report on Corporate Governance.
- Drafting legal opinions and preparing monthly reports on matters handled for clients.
- Providing corporate legal advisory services to Government Departments and assisting with statutory compliance requirements.
- Conducting legal compliance audits and advising on relevant legislation, including:
- Public Finance Management Act (PFMA)
- Municipal Finance Management Act (MFMA)
- Labour Relations Act (LRA)
- National Credit Act (NCA)
- Advising on and ensuring compliance with legislation, including:
- Financial Advisory and Intermediary Services Act (FAIS)
- Financial Intelligence Centre Act (FICA)
- National Credit Act (NCA)
- Companies Act, 2008
- Consumer Protection Act (CPA)
- Providing general corporate legal advisory services and maintaining day-to-day liaison with clients.
- Providing legal services to a diverse client base, including:
- Retail and commercial banks
- National and provincial Government Departments
- Private-sector clients
Qualifications & Experience:
- LLB degree required; LLM advantageous.
- 2–5 years’ post-admission legal experience.
