About Us

The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab, the North Carolina Justice Academy, and the Sheriffs’ and Criminal Justice Education and Training Standards Divisions.

Recruitment Range: $76,041 - $90,414

Investigations and Civil Litigation

1. Establish and timely carry out an appropriate investigation to develop evidence, if any, to support specific legal theories. This may include talking to consumers, review of other agencies’ records, directing the
gathering of information by consumer specialists or consumer investigators.
2. Select cases for enforcement activity which will have the most impact on the public. Factors to be considered include the number of complaints, number of victims, harm per victim (monetary or otherwise), likelihood of
repetition or continuation, past history of the violator, clarity of law violation, violator’s intent, precedential value and likelihood and effectiveness of private or other government action to remedy or prevent violations.
3. Prepare, file, and litigate cases in trial and appellate courts where negotiation of an appropriate settlement is not possible. Draft and file amicus curiae briefs in private appellate cases or in cases from other states involving important consumer protection issues.
4. Negotiate settlement of cases as appropriate.
5. Represent the Attorney General in multi-state and state-federal efforts to investigate and stop deceptive and fraudulent business practices which are nationwide in scope. This function may involve consulting with other states by conference call and in writing, participating in direct negotiations on behalf of other states or coordinating enforcement actions if negotiations fail.
Advise & Assist other Division Employees
6. Advise and assist other attorneys, specialists, and investigators in their duties, including giving appropriate instruction in the law. Assist head of division in the day-to-day supervision of specialists and clerical staff, and
respond to public concerns and complaints regarding their efforts.
Liaison with Business and Professional Groups
7. Work with businesses as well as business and professional groups, including trade associations, Better Business Bureaus, etc. to develop mechanisms such as best management practices, guidelines, or dispute resolution mechanisms to improve the protection of consumers and fairness to business.
Criminal Briefs
8. Brief and argue criminal cases on appeal.
Statute/Rule Drafting
9. Research and draft proposed statutes and rules pertaining to consumer protection issues. Make presentations to the legislative committees or rule-making bodies as necessary.
Responding to Requests for Legal Opinions
10. Respond to requests for legal opinions from members of the General Assembly or other government officials.
Responding to Public Inquiries
11. Respond to public inquiries, including those from the press and local law enforcement officials.

Knowledge Skills and Abilities/Management Preferences

Management Preferences:

  • Litigation Experience
  • Consumer Protection Experience or Experience with the NC Unfair & Deceptive Trade Practices Act
  • Criminal Appellate Brief Experience

Licensed to practice law by the North Carolina State Bar and one year of professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
